New Client Contract
CONTRACT AND LEGAL CONSIDERATIONS
For the purposes of this document, the terms Client, Owner, Pet Owner, and Customer are synonymous with the person contracting services for one or more domestic animals.
1. A Service Request must be submitted and approved by your concierge before service is provided for any period.
Once a day service requests for an ALL CAT/SMALL PET household (no dogs) will automatically be put into the “Anytime” time block of 6AM to 9PM, unless one or more of the pets is receiving prescription medication that needs to be administered within one of our specific 3-hour time blocks.
2. A 50% deposit is due at the time of reservation for ALL vacation, work travel and holiday clients. This payment is non-refundable. Reservations are not held until the deposit is received by Winter Park Pet Concierge. Reservations for not yet cleared PayPal payments will be honored. Invoiced services not paid within 5 business days after the due date will be deleted and removed from the queue.
Pricing Considerations
Winter Park Pet Concierge’s prices are within industry standards and most service prices are set. However, some service rates can be determined based on multiple operational factors, including but not limited to:
• Location of the residence
• Number of pets in the household
• Number and type of visits requested
• Preferred service dates and time blocks
• Route planning, staffing availability, and scheduling efficiency
Prices on our website are our base standard prices. Rates may vary based on these factors and are subject to change depending on availability and operational requirements.
Installment Payments for Future Services
Installment Payment Schedule
For service requests scheduled to begin more than thirty (30) days from the date the invoice is issued, payment shall be made in two installments:
• Fifty percent (50%) of the total invoice amount is due immediately upon receipt of the invoice and is non-refundable.
• The remaining fifty percent (50%) balance is due thirty (30) days prior to the first scheduled day of service.
If the client cancels services prior to the thirty (30) day payment due date, the remaining balance will not be due.
If the client cancels services on or after the thirty (30) day payment due date, no refunds or credits will be issued, and all funds paid are forfeited in accordance with the Cancellation Policy.
Clients are welcomed to pay their invoice in full upon receipt if they desire.
Services that have a deposit on record will be charged a late fee if remaining balance remains unpaid 5 business days after the due date. Clients with a regular or ongoing schedule will be billed either weekly or monthly with payment due the month prior to service for monthly billing and the week prior to service for weekly billing. Ongoing clients scheduling vacation, work travel and holidays visits will have them added to their next invoice.
50% of the balance of Wedding Service invoices are due immediately upon receipt and the remaining balance is due 90 days prior to the day of service. All funds are non-refundable. Our “Pet Taxi” service cannot be used as a substitute for our “Wedding Pet Attendant” service.
3. There will be a $105 service charge for each returned check. The bank which Winter Park Pet Concierge is drawn on puts checks deposited through three times prior to notifying us there is a problem. The fee for this is $35 for each time it is put through.
4. Unpaid service may be canceled without notice, including prior to or during the service period. If an invoice remains unpaid 7 days after the due date, a $25 late fee will be added. All services must be paid for in full before service is rendered.
5. CANCELLATION CHARGE SCHEDULE EFFECTIVE 1/1/2026
Winter Park Pet Concierge DOES NOT GIVE REFUNDS OR CREDITS for vacation, work travel or holiday pet care services that are canceled. For clients with an on-going schedule, cancellation requests must be submitted 48 hours prior to service and will be credited to the following invoice. ALL refunds must be used within one year (365 days.) At the end of this time, the credit becomes a gratuity to the company.
SPECIAL NOTES FOR CANCELLATIONS:
A. On-going clients who repeatedly cancel service will not be credited for their cancellations and may lose their on-going status.
B. For ongoing clients, there will be NO CREDITS for services canceled less than 30 days prior to Spring Break and from November 15th, through January 3rd of the following year.
C. We will hold a guaranteed space for clients who book and pay for services. NO CREDITS for canceled services will be issued once our schedule is fully booked and we are turning away clients.
D. Invoices for vacation, work travel and holiday clients scheduling services within 30 days of departure are due in full upon receipt of the invoice and are non-refundable.
E. Since travel is at the risk of each person, THERE WILL BE NO CREDITS for illnesses or unexpected emergencies unless there is a Florida State mandate against travel.
6. Reservations are made to plan concierge availability and to ensure clients have guaranteed coverage, therefore, vacation, work travel and holiday clients returning home early will NOT receive refunds or credits for unused services scheduled. Clients are required to pay for their entire trip, regardless of when they come home. This also applies to ongoing clients who come home early.
7. Requests for service scheduled to begin in 24 hours or less will incur a $25 fee for each visit requested. A $10 per visit holiday fee will be added to each visit on the following days. New Year's Day, Valentine's Day (if this holiday lands on a weekend day, you will be charged this fee for every visit scheduled on both Saturday & Sunday), Easter, Mother's Day, Memorial Day, Father's Day, 4th of July, Labor Day, Veterans Day, Thanksgiving, Black Friday, Christmas Eve and Christmas Day, and New Year's Eve.
8. Concierges enter the residence with the understanding that the client and all others with access to the residence will NOT be present at the time of service. In the event that the client or any other individual with access to the residence is present during the time of service, they agree to be adequately dressed for the duration of the visit. If ANY individual, other than the client, other residents of the service home, or other known third-party service providers, is present in the residence at the time of service, Winter Park Pet Concierge reserves the right to cancel the scheduled service without notice and without a credit/refund of payment being made to the client. Any exceptions must be authorized in advance and appropriate waivers signed.
Journals are sent to Pet owners after each visit with details of the visit. While we strive to make sure a journal is sent in every case, they are not guaranteed. Pet owners who have given permission for pictures to be taken will receive pictures in most journals unless your pet does not come out for a picture.
9. Winter Park Pet Concierge is not responsible for damage to the home beyond the control of the Concierge. This includes, but is not limited to leaks, electrical problems, and acts of nature. In these situations, the company will attempt to contact the client and then the emergency contact before making a subjective decision on dealing with the problem. All repairs and related fees (including Special Service, emergency service time and coordination fees) will be paid by the client, or fully reimbursed to Winter Park Pet Concierge within 14 days.
All households serviced by Winter Park Pet Concierge must have running water that is accessible to the Concierge. Water cannot be turned off during times of service even if the pets water source is bottled water.
10. Winter Park Pet Concierge is not responsible for any damage to property of the client or others unless such damage is caused by a negligent act of the Concierge. Winter Park Pet Concierge agrees to remain insured through PSI or a comparable pet sitting liability insurance entity during each service period. Winter Park Pet Concierge accepts no responsibility for loss to the premises if other individuals have access to a client's home, or if the home is not properly secured. This includes, but is not limited to client's who leave doors, doggy doors, windows, garages, fences, any security barrier open or unlocked. It also includes clients who allow neighbors, family members or other service providers to enter the home while they are gone. Pet Owners with doggy doors left open must sign a waiver releasing Winter Park Pet Concierge from liability. We do not have the ability to supervise pets outside of our care.
After accepting Care Custody and Control of a client’s dog(s), Winter Park Pet Concierge will not leave open any doggy doors when we are not on the property; even ones that lead directly to a backyard that is completely fenced in. Winter Park Pet Concierge cannot be held responsible for dogs that have free access to any area beyond the security of the residence. Client must also make sure any holes under their fence that have been dug out by their dog are filled in prior to their departure.
11. At the time that a service is booked or a scheduled meet and greet, the Owner will notify Winter Park Pet Concierge of everyone who has been granted access to the home while they are not present. Our insurance does not allow the coming and going of individuals who are not living in the residence. We assume care, custody and control of your pet when we are pet sitting, so others visiting the home is a liability for our company. Dog walking clients still maintain care, custody and control of their pets.
All clients who allow a non-resident access to their pets or in their homes during times of service MUST sign a waiver that releases Winter Park Pet Concierge from all liability of damages to property and/or injury or death to pets in our care. Only Winter Park Pet Concierge staff is covered by our liability insurance. Winter Park Pet Concierge under no circumstances shares care, custody and control of client pets with non-staff personal. Non-residents may not enter the home once a client has left for a trip unless a waiver is signed. The only exception to this rule is if the client has a “temporary-resident” living in the home while they are away. In this circumstance, care, custody and control of client pets is transferred to the temporary-resident and not to Winter Park Pet Concierge.
Clients whose service residence is for sale and currently on the market, and are dog owners, cannot schedule an Open House or private showing of the residence if they are away from home (out of town) and Winter Park Pet Concierge currently has care, custody and control of said dog(s). Clients of cats and other small pets may schedule an Open House or private showing if the appropriate waiver has been submitted and approved by Winter Park Pet Concierge.
12. Winter Park Pet Concierge is not liable for any loss or damage in the event a burglary or other crime that should occur while under this contract. The Pet Owner agrees to secure their home and yard prior to leaving the premises. Winter Park Pet Concierge will attempt to re-secure the home to client instructions at the end of each visit. While keys are in the possession of a Concierge, they will be either on the Sitter's physical person, or be properly secured.
13. Pet Owner must have legal rights to place the animals in the care of a Concierge, Groomer, Kennel, and/or Veterinary Clinic. The Concierge cannot service a home with visiting pets or animals that do not belong to the resident of the service site without separate sets of agreement forms, including a Legal Considerations Agreement, accepted and signed by each rightful owner(s).
14. The terms of this document apply to all the pets owned by the client, including any and all new pets that the customer obtains on or after the date this document was signed, at any and all locations the owner designates for service. All pets in the residence must be in the client portal regardless of whether or not we are providing service. Under no circumstances is WPPC responsible for any services not rendered to a pet without a profile.
If the client fosters rescue animals, Winter Park Pet Concierge shall be given all available information from the originating shelter/rescue group, including but not limited to health, temperament, interaction with people and other animals, etc. An additional, paid Meet & Greet with that animal is mandatory.
15. Pet Owner is responsible for updating the client and pet profiles, including any and all changes to security camera locations, home entry, food, medications, injuries, restrictions, routine, WiFi service etc. Updated vaccination records are to be provided on a yearly basis.
PLEASE NOTE:
A. Winter Park Pet Concierge DOES NOT administer medication or supplements that are not in the client portal. Hand written notes or medication left out with or without instructions WILL NOT be given unless they are in the pet profile of the client portal. The only exception for hand written notes is when medication is to be administered every other day or on a non-daily schedule. A hand written note indicating the start day for every other day, or non-daily administration is acceptable.
B. Prescription medication will only be given to the pet whose name is on the bottle (original container.) We are unable to administer loose medication that is not is a proper bottle/container with proper labeling stating the correct pet that it is intended to be given to.
C. Insulin & Injectable Medication/Saline Administration and Sharps Disposal
When a pet requires insulin or other medication or saline administration by injection, Pet Owner acknowledges that used needles and syringes constitute medical sharps and must be handled and disposed of properly.
Pet Owner is responsible for one of the following:
• Scheduling and paying for an additional service visit for Winter Park Pet Concierge to safely collect and dispose of used needles; or
• Providing a clearly labeled, approved sharps container or other puncture-proof container in the residence for the safe disposal of all used needles and syringes.
Winter Park Pet Concierge will not leave used needles unsecured, will not dispose of sharps in household trash, and may refuse or discontinue injectable medication/saline administration if proper disposal arrangements are not in place. Any delay or discontinuation of service resulting from failure to provide appropriate sharps disposal will not be eligible for refund or credit.
D. Changes to medications or supplements in the portal must be done by the pet owner/client. Portal information will supersede any and all hand written notes.
E. ALL pets in the residence at the time of service MUST have a completed profile in the portal. This includes any and all pets that WPPC are not providing services to. In the event of a medical emergency, WPPC must have complete profiles to provide to veterinarians and any other healthcare provider. WPPC will under NO CIRCUMSTANCES care for ANY animals that do not have completed profiles in the Precise Petcare Portal. This applies to all pets belonging to relatives, friends, neighbors and others. Pet profiles must have complete feeding instructions, including the brand of food, how much food the pet eats, when the pet eats and where in the house. Pet owners with multiple pets must have separate pet profiles for each pet with specific feeding instructions for each pet. Terms or phrases such as, “same as XXX,” “All pets eat the same food,” and other phrases are not acceptable.
F. Non-staff individuals with access to the house should not be feeding or administering medications. This could easily result in pets being overfed or overmedicated.
G. WiFi information must be completed in the Home Information sections of the portal to ensure that you will receive your journals. We use mobile phones to access our portal for instructions on how to properly care for each pet and each home. If a strong mobile phone signal is not available at your residence, it will be necessary to access our portal via your home WiFi.
H. Clients with alarm systems must put the name of the alarm company and phone number in the portal. This information must not be left blank.
16. Pet Owner is responsible for pet-proofing their house/apartment and personal yard, and the security fences/gates/latches on their property. Winter Park Pet Concierge will not be responsible for the safety of any pets nor be liable for the death, injury, disappearance, or legal consequences of any pet with unsupervised access to the outdoors, this includes access to use a doggy door and indoor/outdoor cats. Indoor cats will not be allowed outside onto the patio unless it is completely closed in and secured.
17. Unless otherwise stated in the Vet Release Form, Winter Park Pet Concierge is authorized to seek any emergency veterinarian assistance needed during visits, at the cost of the client, from any veterinarian as chosen by the sitter. Furthermore, the company is not responsible for the health of the animal as we are not veterinary professionals.
18. Pet Owners are responsible for supplying the necessary safe equipment/supplies needed for care of their pet(s), including but not limited to a sturdy, well-fit harness and collars, for walks. In case of emergencies, firmly affixed vaccination tags, a lead rope or leash, poop bags, pooper-scoopers, litter boxes, cleaning supplies; including dish soap to clean bowls and paper towels, medicines, pet food, and cat litter. Collars, harnesses, gentle leaders/Halti-leaders shall be in good condition (not frayed, torn, etc.) and snug fitting. Pet sitters will adjust the fit if necessary (Velcro tabs should overlap fully.) After much research and practical experience, WPPC will no longer use retractable leashes when walking dogs. We kindly request that you provide a standard leash for our use when caring for your dogs. Winter Park Pet Concierge will dispose of all pet waste incurred during the visit. We REQUIRE that you provide poop bags for this purpose and indicate where you would like these poop bags disposed of. Grocery store bags, whether new or used, are not acceptable to be used as poop bags for dogs due to their compromised nature from tiny holes, tears, manufacturing defects, etc.
Grocery store bags may be used to dispose of cat litter as long as they do not have tears, holes or rips. City waste management as well as apartment and condominiums require double bagging to disposal of cat litter, therefore we require the same.
Prior to each visit, it is the client's responsibility to ensure that pet waste has been removed from any part of the client's property where their pet(s) are allowed to be turned out and the Concierge is expected to traverse. It is also the client's responsibility to leave a reasonably fresh litter box prior to the first day of service as well as a reasonably tidy surrounding area. Clients with excessive waste in the yard, litter boxes and/or inside the home will be charged an Excessive Waste fee of $25 per occurrence. If the physical condition of a pet causes them to urinate or defecate on themselves, we will definitely clean it up, however, the pet owner can be charged an extra fee for additional time staff needs to stay outside the allotted time for the visit.
Clients are required to inform Winter Park Pet Concierge of any short or long-term illness, passing ailment or condition their pets may be experiencing prior to their departure and before service is to commence. Failure to do so can result in an immediate cancelling of services, prior to client’s return.
Clients with electronic litter boxes must provide replacement trays in case the trap becomes full and needs to be disposed of.
Our staff is required to clean pet bowls at least once a day. Therefore, at least one sink in the home needs to be clean and free of dishes for this purpose.
Pet Owner authorizes any purchases necessary for the satisfactory performance of duties. A Pet Owner agrees to be responsible for the payment of such items, as well as service fees for obtaining items, and will reimburse Winter Park Pet Concierge within 14 days for all purchases made plus a $35 Pet Errand Fee.
All electronic water dispensers/fountains should be cleaned prior to the departure of the pet owner. Winter Park Pet Concierge will provide simple rinsing and wiping out of electronic water dispensers/fountains, but should not be expected to clean units that are not kept in good repair or left for an extended period of time without cleaning.
19. Winter Park Pet Concierge will maintain a “no interaction policy” for any pets under our care. For their protection and the protection of others, any pet that is taken outside will not be allowed to interact with other people or pets.
20. Winter Park Pet Concierge reserves the right to adjust the thermostat, close/open windows (as long as it remains safe and secure), and turn the air conditioner on/off, in ALL of our client's homes if our sitters feel the climate is posing a health risk to your pet(s) in our care. We will notify you if any of the said adjustments are made.
21. Pet Owner shall inform Winter Park Pet Concierge of any changes to location and function of both inside and outside surveillance cameras. The specific location of cameras must be disclosed in the surveillance form and the form must remain updated.
Clients who book overnight pet sitting or house-sitting services must have ALL cameras turned OFF in bathrooms and bedrooms assigned for use by the pet concierge during the hours the pet concierge is on property for the overnight stay. Cameras in these locations will be covered and turned off during this time.
22. Controlled Substances Policy
Pet Owner agrees that no illegal or illicit drugs or substances shall be present, used, distributed, or manufactured in any areas accessed by Winter Park Pet Concierge staff during any service period.
If marijuana or marijuana-related products are present in the residence, they must be legally obtained, securely stored, and fully inaccessible to pets and staff at all times. Winter Park Pet Concierge does not permit the use of marijuana by any individual in the residence during the time of service.
Homes involved in the production or cultivation of marijuana must possess all required state and local licenses and be in full compliance with applicable laws.
The presence, use, heavy odor, improper storage, or any condition involving marijuana or marijuana-related products that, in the sole discretion of Winter Park Pet Concierge, poses a safety, health, or insurance risk may result in delayed service or immediate discontinuation of service without refund or credit. This policy is necessary because staff travel between client homes and cannot transfer odors or contaminants to other clients’ residences.
Winter Park Pet Concierge reserves the right to refuse or discontinue services at any time if this policy is violated.
23. Pet Owner will be responsible for ALL medical and veterinarian expenses and damages resulting from an injury to a Concierge, other persons, other animals (including those not owned by the client,) caused by the Pet while in our care. Customer agrees to indemnify, hold harmless, and defend Winter Park Pet Concierge, in the event of a claim by any person injured by the Pet.
24. Emergency Contact Requirement
All clients are required to provide and maintain at least one emergency contact in the client portal for the duration of service. The emergency contact must be reachable during the service period and authorized to make decisions regarding the pet and/or residence if the client cannot be reached.
Failure to provide a valid emergency contact may result in delayed service or delayed care in case of an emergency. Winter Park Pet Concierge is not responsible for outcomes due to missing emergency contact information.
25. It is suggested that arrangements be made with someone to evacuate your pets in case of a disaster (natural or man-made, including weather-related) event/crisis/Code Red. Winter Park Pet Concierge will attempt to see to your pet's safety/care should such events occur but cannot guarantee it. Road closures, curfews and road obstructions including water and debris might impact our staff's ability to care for your pets. It is further suggested that ALL pet owners make arrangements for veterinarians and emergency veterinarians to have payment methods for Pet owners on file so that emergency services are not delayed. Winter Park Pet Concierge does not pay for veterinary bills.
26. This contract permits Winter Park Pet Concierge to accept all future telephone, online, mail or email reservations and provide service without additional signed legal considerations agreements. Pet Owners with access to technology (computer, phone, tablet, etc.) should place service requests online in the Precise Petcare software portal. The client portal will not allow scheduling within 48 hours. Requests for service within 48 hours must be called in to the office. Requests for service scheduled to begin in 24 hours or less will incur a $25 fee each.
Delay of Service / Access Issues
Pet Owner is responsible for ensuring uninterrupted access to the service property, including but not limited to providing correct gate codes and key fobs, ensuring that keypads at all points of entry have fully charged, working batteries and ensuring Winter Park Pet Concierge and its staff are listed with building security or guard services.
If entry to the property is delayed or denied due to access issues beyond the control of Winter Park Pet Concierge, the company reserves the right to charge a Delay of Service Fee to compensate for additional time spent including, but not limited to leaving the property to obtain keys/fobs or authorization and returning to complete the scheduled service. Fees will be assessed per occurrence and may include the full cost of the scheduled visit.
Short-Notice Service Requests
Any service request submitted 48 hours or less prior to the first scheduled visit requires payment in full immediately upon receipt of the invoice. If said invoice remains unpaid at the beginning of the first service day, services will not be rendered, removed from the client portal and are not guaranteed to be reinstated since a paid invoice is what guarantees service.
PLEASE NOTE:
A. Clients are responsible for booking their own services, checking to make sure services are booked correctly and verifying the services on the invoice.
B. Winter Park Pet Concierge is not responsible for incorrectly booked services. Correspondence asking for availability does not constitute a request for service.
C. All scheduling in the portal is a REQUEST for service and is not guaranteed.
D. A TRIP must be entered in the client portal for any service request that requires the client to leave the residence and transfer care, custody, and control of their pet(s) to Winter Park Pet Concierge.
Any TRIP lasting more than one calendar day must be entered under the Trip section of the portal and must include the client’s destination (if applicable), the exact date and time of departure from the residence, and the exact date and time of return.
Trips not properly entered in the portal will delay invoicing and scheduling confirmation and possibly result in Winter Park Pet Concierge declining services.
27. Winter Park Pet Concierge may use their discretion to stop and end service at any time that a pet poses a danger to the safety or health of itself, other pets, other people, or the Concierge. If concerns prevent the Concierge from continuing services for a pet, the Owner authorizes the pet to be placed in a kennel, or previously arranged locale if possible. All subsequent charges, including but not limited to transportation, kenneling, tranquilizing, treating, accessing, and liability, are to be the responsibility of the Owner.
Health and Safety Conditions
Winter Park Pet Concierge reserves the right, at its sole discretion, to refuse, suspend, or terminate services at any time if conditions within the home are deemed unsafe or unsanitary, or pose a potential risk to the health or safety of pets, clients, staff, or other clients’ homes.
For the protection of our staff and all clients, services cannot be provided in homes where fleas or other transferable pests are present. Due to the ease with which fleas can spread to personnel, equipment, vehicles, and subsequent client homes, even the presence of fleas—regardless of severity—constitutes grounds for immediate suspension or termination of services.
If it is determined by Winter Park Pet Concierge staff that conditions within the home are unsafe, unsanitary or both, professional treatment must be completed and verified prior to the resumption of services. Winter Park Pet Concierge is not responsible for services canceled or ended due to these conditions. No credits or refunds are issued in these circumstances.
Other health or sanitation concerns will be discussed with the client when feasible to determine whether resolution is possible prior to discontinuation of services.
Flea Policy
If it is determined by any employee of Winter Park Pet Concierge, while servicing a household, that fleas are present, all services will be immediately discontinued and will not resume until professional treatment of the home and affected pet(s) has occurred. No refunds or credits will be issued.
Due to the risk of cross-contamination, staff are required to immediately cease service and return home to shower and change clothing before proceeding to any other client visits. This interruption may result in delays to other scheduled services.
In such cases, a $100 Service Disruption Fee will be charged to the client to compensate for operational disruption, staff safety requirements, and delays to other client services.
It is the responsibility of the client to make sure that all Client Forms (Key Release, Surveillance Cameras, Pet CPR and First Aid, Photos and Videos, Vet Release) are up to date. Any client with forms that are not up to date and accurate can be subject to having service requests declined and/or having scheduled services cancelled.
28. Winter Park Pet Concierge is not responsible for wilted, dead or otherwise unhealthy plants. Instructions for the care of your plants must be left in the portal; hand written notes are also acceptable. Winter Park Pet Concierge will work hard to follow your directions as precisely as possible but cannot be responsible if the results are not favorable. Please place all indoor plants together on a waterproof surface in plain sight, as your Concierge is not responsible for water damaged areas or missed plants.
29. Because of the safety of your pet(s) and the security of your home, Winter Park Pet Concierge will not leave keys, fobs, openers and/or clickers locked within the residence with no way to get back in, and absolutely under no circumstances can keys be acquired or returned by leaving them underneath doormats or inside mailboxes. Clients who need to have keys or fobs returned to them will need to schedule a 'key drop-off'. If it is necessary that Winter Park Pet Concierge pick up your keys for service a 'key pick-up' will need to be scheduled alongside your requested services.
30. Winter Park Pet Concierge agrees to provide agreed upon services in a manner that is trustworthy, caring and dependable. In consideration of the services as an express condition thereof, the client expressly relinquishes ANY AND ALL claims against the company and its employees, volunteers and Independent Contractors, except those arising from gross negligence. Claims of gross negligence that involve a hired Independent Contractor, hired by Winter Park Pet Concierge, will be the responsibility of the Independent Contractor and the company they represent. All hired Independent Contractors are required to carry liability insurance with optional coverage or bonding through a reputable company.
31. Client agrees to discuss any concerns with Winter Park Pet Concierge within 24 hours of return after service.
32. This agreement is valid from the date signed and replaces any prior Legal Considerations agreements. Client agrees to any future Winter Park Pet Concierge term changes relayed verbally to the client, messaged through Precise Petcare, mailed or emailed in writing to the client, or posted on our website under the heading Terms.
33. This contract may be terminated by either party by giving written notice to the other party. Cancellation terms will apply for services terminated by the client.
34. If the client fails to pay when due any amount owing under this agreement and that failure continues for five business days, or if the client commits any material breach or material default in the performance of any obligation under this agreement and the breach or default continues for a period of five business days after Winter Park Pet Concierge delivers notice to it reasonably detailing the breach or default, then Winter Park Pet Concierge may terminate this agreement, with immediate effect, by giving Notice to the client.
35. This agreement shall be interpreted and construed according to, and governed by, the laws of Florida, excluding any such laws that might direct the application of the laws of another jurisdiction.
36. Both parties waive a trial by jury of any or all issues arising in any action or proceeding between the parties hereto or their successors, under or connected with this agreement, or any of its provisions.
37. All disputes, controversies, or claims arising out of or relating to this agreement not settled through insurance shall be submitted to binding arbitration with the applicable rules of the American Arbitration Association then in effect; with both parties agreeing to bear the cost of arbitration equally.
38. All claims or disputes arising out of or related to this agreement shall be brought in Orange or Seminole County, FL.
39. The Pet Owner states that he/she has read this agreement in its entirety and fully understands and accepts its terms and conditions.
New Service Request Policy
Submitting a request for visits does not guarantee service. Requests are accepted on scheduling availability and based on a first come, first served basis. You will receive a confirmation email for each service request that is assigned to a concierge. Furthermore, you will be notified both by email and a phone call if we are unable to confirm your service request(s). Text messages, seeking confirmation of submitted requests, will not be answered; text messaging is reserved for out of town clients in emergency situations only.
If service is to begin 72 hours after the day the service request is made, a determination and notification of whether or not we will be able to confirm your request will be made within 48 hours. Same day service requests and requests that are less than 48 hours away from the time of request will be determined more quickly.
